1. Eligibility

You must be at least 18 years old, or the age of majority in your state, to purchase from us. By ordering, you confirm that the information you provide is accurate and complete.

2. Products & pricing

We work to display product colors, descriptions, and prices accurately. Prices are in U.S. dollars and may change without notice. We reserve the right to correct errors, limit quantities, and refuse or cancel any order, including after it has been placed. If we cancel an order after payment, we will issue a full refund within 7 business days.

3. Orders & payment

Your order is an offer to buy. We accept it when we send an order confirmation or ship the product. Payment must be received in full before shipment. Applicable Colorado and local sales tax is added at checkout. We accept Visa, Mastercard, American Express, PayPal, Apple Pay, and Google Pay via our PCI-compliant payment processor.

4. Shipping & returns

Delivery is governed by our Shipping Policy and returns by our Refund & Returns Policy, both incorporated into these Terms by reference.

5. FTC Mail/Internet Order Rule

In compliance with the FTC Mail, Internet, or Telephone Order Merchandise Rule (16 CFR 435), we will ship your order within 30 days of receiving payment. If we cannot meet this deadline, we will notify you and offer the option to cancel for a full refund or consent to the delay.

6. Intellectual property

All content on this site — including the LINKSMITH name, logos, product designs, text, and images — is owned by or licensed to us and protected by U.S. and international law. You may not use, reproduce, or distribute it without our written permission.

7. Acceptable use

You agree not to:

• Misuse the site or attempt unauthorized access to our systems.
• Interfere with the site’s operation or other users’ experience.
• Use the site for any unlawful purpose, including fraud or money laundering.
• Scrape, crawl, or use automated tools to extract data without our written permission.
• Submit false, misleading, or infringing content.

8. User-generated content

If you submit reviews, photos, or other content to our site, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our business. You represent that you own or have the rights to the content you submit and that it does not violate the rights of any third party.

11. Indemnification

You agree to indemnify and hold LINKSMITH harmless from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of the site, your violation of these Terms, or your infringement of any third-party rights.

12. Force majeure

LINKSMITH is not liable for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, acts of God, war, terrorism, pandemics, government actions, labor disputes, or disruptions to internet, telecommunications, or payment infrastructure.

13. Dispute resolution & arbitration

Any dispute arising from these Terms or your use of the site will first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved within 30 days, it will be resolved through binding arbitration administered by the American Arbitration Association in Denver, Colorado, under its Consumer Arbitration Rules. You may also bring claims in small claims court in Colorado if they qualify. You waive any right to participate in a class action or class arbitration.

14. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any court proceedings (to the extent arbitration does not apply) will be in the state or federal courts located in Colorado.

15. Changes

We may update these Terms from time to time. The “Last updated” date shows the latest revision. Continued use of the site after changes means you accept the updated Terms. Material changes will be communicated via email or prominent notice on the site.
